1. Who We Are
CinemaFreely (cinemafreely.com) is operated by Prakash Madhavan Nair, trading as NOVOBRIL(ABN 42 989 876 644), a sole trader based in Point Cook, Victoria, Australia ("we", "us", "our"). These Terms of Service ("Terms") govern your access to and use of CinemaFreely (the "Service"). "You" means anyone who accesses or uses the Service. By using the Service, you agree to these Terms — if you do not agree, do not use the Service.
2. Eligibility
You must be at least 13 years old to use the Service (see our Privacy Policyfor more on children's privacy). If you are under 18, you should only use the Service with the involvement of a parent or guardian.
3. No Account Required
CinemaFreely is a free service. It does not require you to create an account, register, or provide any personal information to use it, and there are no subscriptions, paid plans, or billing of any kind. Any content saved for your convenience — such as your watchlist or watch history — is stored only in your own browser and is never transmitted to or stored by us; see our Privacy Policy for details.
4. Description of the Service
CinemaFreely is a movie discovery and search service. We index publicly available links to full-length movies hosted on third-party platforms — primarily YouTube — and enrich them with metadata from The Movie Database (TMDb). We do not host, upload, download, re-stream, or store any video content ourselves. Clicking a movie link takes you to the original hosting platform, where playback happens entirely under that platform's own terms.
5. Acceptable Use
You must not use the Service to:
- Break any applicable law or regulation;
- Scrape, crawl, or collect data from the Service at scale, or attempt to reverse-engineer or bypass its security, access controls, or rate limits;
- Submit false, misleading, abusive, or infringing content via the link submission, reporting, or voting features;
- Interfere with the operation of the Service or attempt to gain unauthorised access to any part of it, including the admin panel;
- Resell, sublicense, or use the Service for a commercial data-aggregation purpose without our written consent.
We may block access to the Service (including by IP address) for any violation of this section, with or without notice, depending on severity.
6. User Submissions
If you submit a YouTube link, report a broken source, or vote on a submission, you confirm the information you provide is accurate to the best of your knowledge. We may review, edit, reject, or remove any submission at our discretion, and we are under no obligation to publish or act on any submission.
7. Intellectual Property
The Service itself — its software, design, curation, and branding — is owned by us and protected by copyright and other intellectual property laws. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable licence to use the Service for personal, non-commercial purposes. Movie titles, posters, descriptions, and other metadata belong to their respective rights holders and are used under our data providers' own licence terms (see §8). All video content belongs to its original creators or rights holders and is hosted exclusively on third-party platforms.
If you believe content linked from CinemaFreely infringes your copyright, see our DMCA Policy.
8. Third-Party Services
The Service relies on, and links out to, third-party providers, including:
- YouTube — the actual host of virtually all video content linked from the Service; your viewing is subject to YouTube's Terms of Service;
- The Movie Database (TMDb) — movie metadata; this product uses the TMDb API but is not endorsed or certified by TMDb;
- Google Cloud Platform — hosting and database infrastructure;
- Cloudflare — DNS, CDN, and request routing.
We are not responsible for the content, availability, or conduct of these third-party platforms — your interactions with them are governed by their own terms.
9. Termination and Suspension
Because there are no accounts, there is nothing for you to "terminate." We may, however, suspend or block access to the Service (including by IP address, in whole or in part) at any time and without notice for anyone found to be in breach of §5.
10. Disclaimers
The Service is provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or completely secure, or that any linked movie will remain available — third-party links may be removed or become unavailable at any time, outside of our control.
11. Limitation of Liability
To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, or loss of profits, revenue, data, or goodwill, arising from your use of, or inability to use, the Service, even if advised of the possibility of such damages. Because CinemaFreely is a free service with no payment relationship, our total aggregate liability to you for any claim arising out of or relating to the Service is limited to AUD $100.
As a sole trader, Prakash Madhavan Nair's personal assets are not shielded by a corporate structure — this limitation of liability clause, together with the free, non-commercial nature of the Service, is the primary protection in place. Nothing in this section excludes liability that cannot lawfully be excluded (e.g. under the Australian Consumer Law) or liability arising from our fraud or wilful misconduct.
12. Indemnification
You agree to indemnify and hold us harmless from claims, damages, and expenses (including reasonable legal fees) arising from your breach of these Terms or your misuse of the Service, except to the extent caused by our own breach or negligence.
13. Changes to These Terms
We may update these Terms from time to time. The "Last updated" date at the top of this page reflects the most recent revision. Continued use of the Service after changes take effect constitutes acceptance of the new Terms.
14. Governing Law & Disputes
These Terms are governed by the laws of Victoria, Australia. You submit to the non-exclusive jurisdiction of the courts of Victoria, Australia. Before commencing formal proceedings, please contact us at legal@cinemafreely.com so we can try to resolve the issue informally.
